Who May Own

• Section 12651 of California's 2008 Dangerous Weapons Control Law allows anyone to purchase or own a stun gun in California unless he is a convicted felon or someone who has been convicted to an assault crime, in California or elsewhere; a narcotic drug addict; or minor, with exception to minors 16 years of age and older with written consent of a parent.
  
  

Violation

• According to Section 12650 of California's 2008 Dangerous Weapons Control Law, selling a stun gun to a minor who is not 16 years of age or older with the written consent of a parent or guardian is a public offense. The first violation subjects the seller to a $50 fine, while subsequent offenses are misdemeanors, which have a maximum term of imprisonment of one year and a maximum fine of $1,000.
  
  

Requirements

• According to Section 12652 of California's 2008 Dangerous Weapons Control Law, every stun gun sold must have the manufacturer's name and serial number stamped on the stun gun. Section 12653 requires that stun guns sold be accompanied by an instruction booklet. If a seller of a stun gun fails to provide a booklet, Section 12653 imposes a $50 fine for each offense.
  
  

State Buildings

• According to California Penal Code Section 171b, it is a criminal offense to bring a stun gun into a state or local public building, or into a meeting open to the public. The maximum penalty for violating this provision is one year in prison.
  
  

Airports and Harbors

• According to California Penal Code Section 171.5, it is a criminal offense to bring a stun gun into the secure area in an airport or into a passenger vessel terminal in a port or harbor. The maximum penalty for violating this provision is a fine of $1,000 and six months imprisonment.
